サマータイムと始業、終業時刻

サマータイム制が、省エネに効果があるということで、日本政府が、今年の夏から導入することを検討している、という報道があります。日本全国で、時計の針を1時間早めてしまうというやり方(Turn your clocks ahead one hour)、個々の企業が独自に時差(前倒し)出勤制度を作って対応するやり方などいろいろ考えられます。

このサマータイム(Summer Time)ですが、アメリカやカナダでは、Daylight Saving Time (DST)と呼んでいます。Summer Time　と言っているのは英国を始めとするヨーロッパの国々です。

病者の就業禁止-Temporary Prohibition of Work

東日本大震災の被災地と被災された方々については、国を挙げて復興に取り組んでいますが、これから、優先的に取り組まなければならないのは、波伝染病への感染予防でしょう。

２年前、新型インフルエンザが流行し、昨年夏に収束するまで、会社も、感染者の自宅待機、短期休業などいろいろな対応を求められました。私たちも、手洗いやうがいをして、感染予防に努めました。手洗いとうがいはその後習慣になった方も多いのではないでしょうか？

健康診断-Physical checkup

春になると、定期健康診断を行う会社が多いのではないでしょうか。
この定期健康診断は、労働安全衛生法（Industrial Safety and Health Act）６６条という法律で、会社が少なくとも1年に1回行うことを義務づけています。また、社員50人以上の会社に対しては、定期健康診断の結果を労働基準監督署に報告しなければなりません。

計画停電と雇用調整助成金

東日本大震災の影響により、売上が落ちてしまったり、生産量が減少しているときに、社員を解雇せずに、休業するなどの方法で、休業手当を払い、雇用を維持している会社に対しては、助成金を申請して、休業手当の一部を補填することができます。

この雇用調整助成金（中小企業緊急雇用安定助成金も含みます）の元締めである厚生労働省が、助成金をもらえる基準を緩和しました。

その一番大きなものは、被災地でなくても、計画停電が行われたことによって、売上や生産量が、前月か前年同月に比べて５％以上、減少してしまったら、対象になるということです。
今までは直近３ヵ月の平均がその前の３ヵ月か前年同期の３ヵ月の平均と比べるというものでした。

具体的には、今年３月の売上が、２月の売上か去年３月の売上金額に比べて５％以上、下がっていれば対象となるということになります。

助成金の対象となるのは、これから休業して、社員を休ませて、休業手当を払ったら、それに対する助成となります。計画停電による休業に限定されません。（神奈川労働局確認済み）

Qualification requirements for the subsidy have been eased for the company or factory located in the area of rolling blackout.

If the sales or production amount in this March was decreased by 5% or more compared to the one in February or in the last March, such company or factory may apply the subsidy against the forthcoming business suspension. Please see the previous page of this blog for the details.

労災による災害補償

大きな余震が続く、東日本ですが、この東日本大震災によって、就業場所で、ケガをしたり、亡くなられてしまった方が、たくさんいらっしゃいます。
大地震は３時前に起きていますから、会社で仕事をしていて被災された方も大勢いらっしゃるでしょう。労災は適用されるのでしょうか？労災は天災事変による災害には適用されないのが原則です。

Governmental subsidies for maintaining employment(Joseikin/助成金） 2011.4.1

There are many employment maintenance support programｓ available from the Ministry of Health, Labour and Welfare (MHLF).

Right after the Tohoku-Kanto earthquake and Tsunami, one of the most practical subsidy for the company located in the disaster-hit prefectures, such as Aomori, Iwate, Miyagi, Fukushima and Ibaraki is the the Immediate Employment Security Subsidy for SMEs (Small and medium enterprises).

This program supports SMEs trying to maintain employment instead of dismissing their employees in the face of the disaster.

For example, when an employer provides their employees with allowance for absence from work against the day(s) of business suspension due to the disaster, this program will share the expenditure upon application.

The application made by this coming June 30 can be backdated to March 11, so that the subsidy money will be granted retroactively to March 11.

To be qualified for the subsidy money, at least your company must
1.  enroll in the governmental employment insurance.
2.  have paid the contributions every year.
3.  have drawn up the rules of employment and have submitted them to the Labor Standards Inspection Office.
4.  prove that the sales amount of March 2011 has been decreased by at least 5% compared to the previous month or to last March.

計画停電による休業（Suspension of business)

東北関東大震災の影響で、首都圏を始め、広い範囲で、計画停電が行われています。計画停電中は仕事ができないので、その時間帯、会社は休まざるを得ない状況が続いてます。いわゆる休業です。
英訳するとLayoffという単語が出てきますが、ここでは、ニュアンスが少し違いますね。ちなみに、計画停電は、Rolling blackoutsとか、rolling power cutsなどとと訳していることが多いようです。Rolling（巡回しながら）とは上手い英語表現ですね。
